George W. “Trey” Tate, III is a Florida Bar Board Certified Attorney in Construction Law, which is achieved through the highest level of competency and experience within construction law, skilled in both contract preparation and complex construction litigation.

Tate handles construction contract negotiating and preparation on projects of all scale and type, from multi-family projects to horizontal and vertical projects on the multi-billion dollar “Medical City” project at Lake Nona. Tate handled, among other current projects, the original design and construction and multi-party project agreements to commence Medical City, including the Sanford-Burnham deal. Tate is adept at advising clients on all aspects of contract negotiating and drafting, including delivery methods such as construction management at risk and design-build, and regularly advises clients on the myriad of issues that arise in active construction projects on a daily basis.

Tate also specializes in complex construction litigation with a special emphasis on delay claims, construction defect claims, payment disputes, lien and bond claims and bid protests for his construction clients. He recently assisted a large general contractor client in handling numerous lien and payment bond issues that arose when a major subcontractor failed on a highrise condominium project, achieving a favorable resolution of all claims for his client.

Tate is an experienced commercial litigator who has handled a wide variety of disputes including landlord/tenant, commercial contract disputes and trust litigation. He recently obtained a favorable verdict in a multi-million dollar dispute between two internet companies.

As Deputy District Attorney for the County of Los Angeles, Tate tried nearly 30 cases to jury verdict along with conducting numerous bench trials. In this capacity he spent nearly every day in court, conducting hundreds of hearings and questioning thousands of witnesses. With a caseload of over 3,000 cases per year, he developed strong negotiating skills which he currently uses to achieve success for his clients during mediations and settlement conferences.

Tate was designated a “Florida Legal Elite Up & Comer” by Florida Trend Magazine in 2008 and named a “Rising Star” in the 2009-2014 “Florida Super Lawyers” by Super Lawyers magazine. Tate swam competitively for Princeton University’s varsity swim team.

Significant Cases

Assisted both a large regional developer and a private homeowner in handling lien claims brought by subcontractors working on their properties.

Currently serves as counsel to the Greater Orlando Aviation Authority in a multimillion dollar claim brought by a large paving contractor involving project impact and delay issues.

Served as trial co-counsel in the representation of a supplier of thermal expansion joints to a power plant in Volusia County. He was instrumental in obtaining a favorable jury verdict for the Firm’s client which resulted in the full payment of the client’s claim.
